Sour Grapes

Post by Nasturtium »

I was terminated from my job by note "leave your keys and parking pass on your desk after work", December 23rd, 2015 - after nine (9) years of work, following the retirement of an associate

I was terminated the day after my 55th Birthday and 32 years with the Company.

Didn't bother me at all.
I got Married because I was sick and tired of finishing my own sentences.
That's worked out great for me!

An acquaintance was just terminated after 17 yrs service.
Some one fresh out of school was put into his former position at a fraction of the wage.

Productivity is down, complaints are up, damaged equipment and downtime is up.

From what I see, there is now a safety issue to the general public.

Yup, makes sense to me.....NOT....

Up-side, his new gig...so far....is his dream job.

The new company should feel blessed to get him.

Did you get one month's severance for each year of loyalty? That is the 'common law' award most often granted by judges when cases like this go to court. The Employment Standards regulation of one week up to a max 8 for every year employed is the bare minimum allowable by the letter of the law. Judges clearly think otherwise and award higher severance packages.

My employeer had no intention of paying severence.

So, Yes, KC, I had to look into this myself prior to leaving the office that same day.

The Unemployment Office directed me the the BC Employment Standards Office where I completed their form calculating years of service - which was deductible from my EI claim.

I did receive my severence pay without going through court

If you are willing, I'm curious whether you got the bare minimum, or the common law value.

I asked for, and was paid for one week per year - to the eight year max, and was happy to get that.
