I really don't appreciate the constant attacks. I'm "denouncing" people who write off alleged human rights issues as cases of hurt feelings. Doing so is basically mocking the Charter and the entire judicial system.
I have to agree with GB's view as well. Discrimination is about being treated unfairly or prejudicially as a DIRECT RESULT of our race, religion or sexual orientations. There is no mandate for a host such as the Delta Grand to provide over-service to someone they assess as being inebriated and I think the margin for error favors their position because they DO become liable to a civil action if they continue to serve someone who is drunk. It would be a gross miscarriage of justice to be forced to serve a drunk simply to avoid a Charter lawsuit. Moreover, IF she brings a suit and the judge finds that she is abusing the legal system or simply being malicious, she could end up with costs (or even double costs under the right circumstances against her. She might want to rethink the strength of her "evidence".
It is also "mocking the Charter" to use it irresponsibly and as a defence to inappropriate or drunken behavior. I don't quite think that was what Trudeau's cabinet had in mind.

Doesn't sound like she knows how to have fun AND behave herself in public to me. Maybe the bar has been tolerant in the past and they're getting tired of her being louder, drinking more and kissing men there.
I do admit a bias toward loud and unruly drunks but it's just because I can't stand them! lol

Well MAYBE (and I'm just saying maybe), we should wait until some actual facts are released rather than speculating on what could be an over-blown case of the misunderstandings mixed with alcoholic perceptions (And what I'm sure is also a mix of the media getting maximum value out of the story). I'm sure the bar was busy (being after a rockets game), and I'm sure there will be some witnesses who will clear the air up.

Also, what does she have against Texans? How does she even know that they were Texans? Does she have a bias against Texans? I think we need to take this thread in that direction. Seems about as good a use of time as some of the criticism thrown towards either party involved here.

occasions in my past!
I geuss I should have filled complaints with a tribunal or commission or someone instead of just
grabbing a cab or staggering home.
Remember, any business has a right to refuse service to anyone, I didn't think they needed
to explaint to anyone "why"

how did it fall into the toilet exactly? Because we aren't all single-mindedly just backing these women, and screaming "Bully for you for using the government to be your personal judge, jury and executioner, on our dime, no matter how badly you were acting in public!" Give me a break. This COULD be blatant abuse of the Charter, or could not be, but at the very least we should be discussing whether this was such big discrimination or just the bar acting responsibly and ejecting drunk and abusive patrons. No one is saying "rip up the Charter" - what we are saying is stop abusing the Charter with frivolous charges that our frothing-at-the-mouth radicals running our HRC's are only too happy to jump on and then persecute possibly completely innocent people. Can you understand the difference?
One poster, who seems to be taking this counter-point as "constant attacks" for some reason, mentioned that it is a "slippery slope" if we do not allow this kind of behaviour to continue. I would counter that it is a "slippery slope" if we continue to turn a blind eye to people who run off to the HRC's, just because they feel that their feelings were hurt, with no regard for how they acted in public. The cost to the taxpayer of this frivilous behaviour is one thing, but the cost to the potentially innocent party, who now has to be subjected to interogation by HRC star chambers and forced to hire lawyers at their own expense, is quite another. It's all relative - it's easy to sit on a high horse and crow about how the Charter is so great, until one day you are the one being charged, and you know you did nothing wrong, but are subjected to the awful process anyway.

This is what I was thinking.
This isn't about Human Rights, it's about a business not wanting to serve you, for WHATEVER reason. I don't care if it's because they don't like your hair, you're not wearing shoes or because you're gay. It's their establishment. If they don't want you there, too bad for you.
Stop whining and go somewhere else. There are plenty of places to have a beer and make out.

Yeah, no kidding. Who cares about basic rights and freedoms anyway?
In my experience, Kelowna is not tolerant of homosexuality. I mean, this very thread has people saying it's fine to be homophobic and racist. Obviously, this case can't be proven at the present time, but the allegations certainly don't surprise me.

But the difference is is that if it was a hetrosexual couple kissing then it would not have been an issue and would not been asked to leave. If you have been discriminated against in the pat and you are OK with it then that is your deal, for some it is very hurtful and uncalled for. Any business does have a right to refuse service to anyone, but if you base that refusal on sexual orentation, race etc then you are crossing the human rights line.
Equity will not suffer a wrong to be without a remedy
