Anything can be used as an excuse - bottom line is final verdict, sentence and case law.
Truths can be backed up by facts - do you have any?

What I do is none of your concern but when a witness will testify the guy tried to flee (not moving his truck just because), I think that will carry more weight than someone who was speeding, ran a red, appeared intoxicated and hurt someone.

No it isn't but if you want to talk like you know everything about a subject people might ask what your qualifications are.... just saying.

couple that with having the misfortune of hitting a police car, we might see heavier penalties to set an example if found guilty.

One doesn't have to be a lawyer nor a judge to determine that driving drunk and nearly killing a man, then being a coward and trying to run from the scene means big trouble.

No but it sure helps if you want to prove your case to a judge.

he'll get what the judge states and that penalty can vary a great deal.

May vary but there's always a minimum the judge has to follow.

The damage to the vehicles was extensive and there will be a determination on speed. The member was extremely lucky.

Thats true fancy, and like i've been pointing out that will depend on many factors.
I doubt any of the posters here want to see the minimum penalty for drunk drivers.
