only 2 more years in jail ,to start all over again when he gets out,what a useless judge.
and when he reoffends,and he will this judge should be the one going in jail with him next time

I happen to know one of his victims, while I'm glad they didn't release him, his sentence is still a slap on the wrist for what she went through, she has PTSD from the whole situation he needs to be kept in longer and hopefully there's some kind of sexual offender registry that he will be on for life when he does make it out!

Really did I hear that correctly?
If so she was too young for consent. That would be rape, wouldn't it?
The new law states the age difference would make it rape even if she consented(which she was too young to do by law anyway).

Where is the rape charge?

Help someone, I am at a loss on this case.

i read the article and am still wondering............how did this get ignored?
Why is this not being reviewed by the Attorney General ( I recall the previous A.G. stepped in on cases where the sentencing was out of line with the crime)
Why do we even bother to have laws when Judges, Prosecutors and police seem to ignore them?

Answer:
In Canada, we don't have statutory rape laws, we have age of consent. (As well, we use the term "sexual assault" not "rape" in our Criminal Code).

Our Criminal Code (which defines sexual assault) is federal, not provincial. So that means that the age of consent is the same in BC as it is in any other province.

As of May 2008, the age of consent (the age one can legally consent to sexual activity) is 16, with the following three exceptions:

The age of consent is 18 years if the relationship exploits the youth, e.g. pornography, prostitution, or if the older person is in a relationship of dependence, trust or authority (e.g. babysitter, teacher, soccer coach). Sexual activity can also be considered exploitative based on the nature and circumstances of the relationship, including if the young person was exploited.

So that youth aren't criminalized for similar age sexual activity there are also 2 other exceptions:


Peer Group Exception: A 14 or 15 year old can consent to sexual activity with an older person as long as that person is less than five years older and there is no relationship of trust, authority or dependency or any other exploitation of the young person.



Close in Age Eception: A 12 or 13 year old can consent to sexual activity with another young person who is less than two years older and with whom there is no relationship of trust, authority or dependency or other exploitation of the young person.

I just assumed Sexual Exploitation included Sexual Assalt, which includeds statitory rape. I might be wrong. The odd part of this case ( i guess) is the crown and the defense both agreed on a 2 year term but the judge stepped it up and issued a longer sentence.
