Access to Crown land

Another good bill tabled by Andrew Weaver. I can think of a couple of locked gates to Crown land that should be removed, one right here in the south Okanagan. Has anyone else been locked out of a favourite fishing hole, hiking trail, etc.?

Dream come true for all those who have an ATV, dirt bike &/or 4x4. Can lay tracks all over the place that was once locked away, what great idea. :up: :up:

"Green Party leader Andrew Weaver has introduced a private members bill that would increase access to public lands for British Columbians.

Weaver first introduced the bill, the Right to Roam Act, 2017, in February 2017 under the previous B.C. Liberal government.

“The ability to access and experience nature is a right for all British Columbians, and we must protect it,” said Weaver.

“Increasingly, however, British Columbians are finding themselves fenced out of wild areas that have been enjoyed by the public for generations. Fences, gates and signs are blocking people from accessing crown land.

This Bill, which is built on a combination of B.C.’s existing Hunting and Fishing Heritage Act and Nova Scotia’s Angling Act, would re-establish the rights of British Columbians to access public lands, rivers, streams, and lakes, and to use these spaces to fish, hike and enjoy outdoor recreation in accordance with the law.”

There's a REASON these places were cut off: idjiots, poachers, pollution, garbage dumpers, sensitive land devastation, illegal logging, over fishing, fires, and disturbance of wildlife.

Not happy with this AT all.
As WW3 develops, no one is going to be dissing the "preppers." What have you done?

Hmm.....I never thought about that. Maybe they could just make the gates narrower :biggrin:

It's a socialist's wet dream to usurp private property rights and confiscate what people have worked hard for all their lives.

Giving up the cornerstone of private property rights, which is defined as "the right to the use and quiet enjoyment" of said property, is disgusting.

Weaver is an absolute idiot. He's catering to the penniless fools who voted for him, promising to give them use of others' property since they are too lazy to work for their own possessions.

I have not read the actual Bill, according to the link provided by OP it speaks of access to fenced off Crown lands not private property.

Added: I'm against it for reasons I've already mentioned via sarcasm.

In the Trout Creek area there is an entry leading to a trail along the creek. I don't know what they call that type of entrance, but it appears that only pedestrians would be able to use it. I've seen this type of entry on other Crown land locations as well. It deters ATVs, dirt bikes, etc. from destroying sensitive habitat.

I have first hand experience with this. One of the things that needs to happen here is education for people opening gates, cutting wire, why they need to open and shut gates most have no idea why , and how to fix a fence if they damage one. Why they get locked is because people leave them open and this can cause unbelievable problems for the lease holder.

What private property, to which people are not currently legally allowed access, are people being given access to?
Nothing I have read suggests that they are trampling anyone's existing rights, but rather giving greater access to public land. It almost sounds as if you are complaining that people who treat public land as their own private land should be allowed to continue to do so, which of course they shouldn't.

Crown leases give private property rights to the lessee. Weaver's bill would allow unfettered access to those lands. That is contrary to Common Law and Canadian law on the subject.

So, it isn't trampling existing private property rights at all. Good to know.

As for the leases, can you please provide a link to somewhere supporting this view, since I would be very surprised if such leases could be affected in retrospect. Obviously going forward such leases and associated conditions are entirely up to the government and laws of that time, but I don't think any existing leases will be significantly affected.

Taxable occupiers of Crown land are required to pay property taxes. Payment of property taxes, in addition to the rental or other fee, is a condition of many Crown land leases, licenses, permits, rights of way, easements and other tenures.

I would think some would not appreciate having their rights trampled.
