All that would answer is what would happen in your scenario. Your scenario is irrelevant as it did not happen.
Here's an example of your logic for you to answer:
Knowing that Dorner had already killed two policemen and 2 civilians, do you think he would have come out with his hands up?

Interesting point and I don't think anybody would think that he would.
This is all hypothetical, however do you agree that those in law enforcement intended on burning that house with him in it? How can you not listen to the audio recordings and believe that's what they intended to do?
On a side note, why not use a sniper loaded with a tranquilizer and shoot him if he came out?

Tranquillizers don't work that quick, and remember, he's already chosen the degree of force the police have to use against him by his own actions. You do not use non-lethal force against someone using lethal force.
Was the shouting of "burn him out" before or during the cabin actually being on fire?

So if no one believes that he had any intention of surrendering, do the police risk him possibly escaping the cabin or do they use extreme measures to neutralize him? Their job in this circumstance was not to just bring him to justice but was also to stop him from continuing what he had been doing, which is killing people.

it would certainly seem that was their intent
he was in the house, and they lobbed what they knew would cause a fire, into said cabin
some were heard saying to burn it down
then they lobbed...it burned and he was in fact...inside

A lot of people say things in the heat of the moment that are regretted later or didn't mean. The fact that the first tear gas didn't work prompted the next more severe batch that would normally drive someone out that would rather live.

I do.
They might regret saying these things in the heat of the moment...but only because it shows intent.
The canisters they tossed in are meant to burn.
These weren't the canisters that just make a lot of fog and noise.
They are designed to burn.
They made no mistake when they chose to lob several of them into a wooden cabin in a forest.
We've got fire!
They sure do.
And will for awhile.

It was awefully convinient that he doesn't have to stand trial. He may have been dangerous to the public but to the LAPD he was a media relations distaster.
