Again?
http://www.theprovince.com/news/drivers ... story.html
In the effort to cut down court time for certain cases, and free up judge and court time.....the province wants to bring in legislation that will have people phone in to dispute their traffic tickets. Guess where the "violators" call? Yup! The Office of the Superintendent of Motor Vehicles!!!! AGAIN taking the "biased" administrative way of disputing...and eliminating the chance for a driver with a dispute to go before an impartial party.
Remember some of us mentioned that we were treading on dangerous ground with these new IRP's, and removing the court system from disputes? Well, it appears that the government is carrying on with implementing more administrative processes...giving "them" the advantage over "us". This needs to be stopped.....NOW!
The OSMV is a steam roller that HAS been started and is beginning to move.....who wants to......or CAN get in the way and stop it?

Yup... play by the rules, know and follow the laws, and what's the problem? And ignorance of such things is no excuse.

You know, that is all well and perfect....IF things and people were perfect! If you can tell me that people, officers in particular do NOT make mistakes.....then what you are saying can stand. What would you say if YOU were given a violation ticket for something you didn't do.....because of assumption or poor evidence? Remember, there is not one perfect person in this world. Well, I'm close.....LOL :dyinglaughing:

Re: Again????
Sorry, I have no sympathy at all for people who don't follow the rules and get written up because of it. As for being perfect and not making mistakes, the first mistake was in not learning and following the rules/laws, and the second one was in still not learning from the experience of getting a violation ticket as a result. In my view people don't make mistakes, they just use that as an excuse to try and avoid being called to task for doing things they shouldn't have done in the first place and having to pay the price.

Re: Again????
So, instead of going to court you can dispute the ticket over the phone?
I see convenience for everybody. If it frees up courts - hey, bonus.

Well if you are innocent of the infraction then just accept the ticket for one you did and weren't caught.

Would you like me to start a list of detailed cases of "persons" wrongfully ticketed? Would you like me to start a list of why ? It would be a list of those that followed the rules but, for some reason....received a ticket. Do you disagree that "perfect" people like yourself get nail in error? I want to live in your world!!! lol I'm saying.....police make mistakes....they are human.....therefore we need to protect our right of standing in a court of law to dispute!

Nope, there are more efficient and less costly means of dealing with minor disputes than tying up the courts. As for me, I have never in well over 50 years of driving received a ticket I didn't deserve, and never disputed one either. Much simpler and less stressful to pay close attention to what you are doing, know and follow the rules and laws, and thus avoid getting ticketed in the first place.

So, you are happy if the system works for YOU, but what about the others that may not be as fortunate? :200:
Our society is based on our rights. Even a criminal has rights....why? Their rights make sure that they get a fair trial, an unbiased forum, making sure that everything is in place for a conviction. In a minor form, this applies to drivers who get a violation ticket. This is what we are loosing with these administrative sanctions and methods.
I am not trying to figure a way out for people to get off from what they have done......I really don't want to see innocent persons wrongfully convicted and not have a proper method of dispute.

Re: Again????
I'm OK with it. Maybe this will help minimize the amount of time I waste going to court when 90-95% of the people who "dispute" the allegations don't show up.....These are all absolute liability offences to which there is no defence of due diligence.....It's going to mean a bunch more work for me on the front end with my attached notes/report for each ticket, more accumulated time than I probably spend in court, but at least I won't waste whole mornings/afternoons or entire days waiting for disputants that don't actually want to dispute their tickets.
All that is required for evil to prevail is for good men to do nothing.
