Why the embellishments? The OP didn't claim their neck was "a little sore" nor did anyone suggest scamming ICBC.

as i have repeated a couple times now unless you have suffered some form of financial hardship you shouldn't get anything why does everyone feel a sore neck entitles them to ten or twenty k peoples attitudes are pathetic nowadays whiplash isn't permanent you don't deserve anything. Personally i don't think icbc should be involved in injury claims they should cover vehicles and property and people should purchase their own coverage for injury or disability loss of work and such

You could be compensated for medical and rehabilitation expenses as well as lost wages due to your injury that are not already covered under your own Basic Autoplan policy.

To the OP and the initial question. You state you are 8 months into this injury and still suffer from pain. Whatever you do, do not take ANY offer from ICBC at this time. If you were under 19 at the time of the accident you have 3 (THREE) years to settle (2 years if 19 or older) with them from the date of the accident. Prior to that deadline you will have to decide the direction you want to go, as in, hire a lawyer. At the 8 month timeframe and you are still suffering pain have your doctor refer you to some specialists. You do not mention if ICBC is covering Physio, Massage, Chiro, etc. Make sure you are utilizing these treatments and be prepared when ICBC says they are cutting off paying these treatments (within your 2-3 year timeframe). If your doctor states "physio and massage", have him put the number of sessions down or ICBC will stop at say 10 sessions and then you have to make ANOTHER doctors appointment to get more sessions. These are all things ICBC does to frustrate the injured party...........but they say it with care in their own way then throw another offer at you to get you "off the books".

Lastly (for now)..........do not listen to ANYTHING "LTD" states on this topic!

Have you kept very DETAILED records?
Copies of your medical exams?
Copies of any CT Scans, xrays, blood tests.
Proof of income before the accident?
Have you sought out and had any physical therapy, chiropractic treatments, massages?
Do you have copies of all of those records?
Have you contacted a "Personal Liability" Lawyer?
Have you had your car repaired? Did ICBC pay for it?
Have you had any conversations with ICBC?

I am sorry, I did not read everything in all of your posts. Forgive me for asking questions that may have already been answered.

also don't complain when your paying 4k plus a year for insurance even tho you've never had an at fault accident :up:

ya karma wont be coming for me sounds as tho plenty of people on here should be concerned i can sure see why rates are where they are tho, its amazing how an easy ten k fixes everyones neck pain lol must be some kind of miracle

So are you by chance a licensed doctor qualified to be passing off the judgments you are?

I know I'm certainly not, but I can tell you one thing, I got whiplash about forty years ago, didn't complain, didn't file a claim, figuring somewhat like you, that it's just a minor thing and will go away.

Well here we are forty years later, and my neck still hasn't fully recovered, so do I wish I had filed a claim in retrospect? Damn right I do. It probably wouldn't have improved my healing any, but at least I would have gotten some sort of compensation, for pain and suffering.

If not such a situation, where clearly my quality of life was diminished, then what pray tell, are pain and suffering awards for exactly?

You seem to be crucifying victims, when it's the ones causing the problem in the first place that need to be crucified.

M2015.............a family member is going through what could very well be your future. Pain was VERY evident at the 8 month mark and we are over the 6 year mark now. What was diagnosed by a "specialist" at 11 months after the accident as "no long term effects evident" was re-diagnosed at the 3 year mark (after going the legal route at the last couple of weeks of the 3 year timeframe) by the same specialist as "injury is permanent and you will have to adjust your lifestyle and career choice".

Now, this to "LTD" means nothing as long as HIS/HER insurance does not go up.

Pain and Suffering are one thing, add up the costs of treatments for a LIFETIME (from a young age) and see what number you come up with..........there's the starting point. Soft Tissue injuries do not equal MINOR as many like to state. The vast majority of these types of injuries do not have long term effects........lets hope yours falls within the majority.
