the guy was deported back in 2013 , then came back illegally again to commit crimes again, so no , in his case he does not get innocent until proven guilty , he is not a usa citizen on top of that.

There is no legal proceeding in the history of Common Law where judges have special rights to thwart officials by using their special privileges.
