Is this illegal?

Post by grammafreddy »

Inquiring minds want to know ...

I invite you for dinner.

You really enjoy one of the recipes I made.

You ask for the recipe.

I get my store-bought cookbook out and copy the recipe out for you.

Is that illegal???

I should hope not. I could understand it being illegal if you were to charge a fee for that recipe, but that would be downright silly.

Maybe if you published it in a book entitled "Grammafreddy's Original Recipes". Other than that, it's probably no more illegal than inscribing a song lyric or a quote in a card to a friend.

Technically, yes it is illegal.

Is anything going to happen to you if you do? No.

Best place for recipes is google.

Chances are dang good you'll find whatever you need there and generally offered in a printable format for free and perfectly legal.

No, it is not illegal. Recipes are a process for creating an edible item, not a creative expression (the latter being protected by copyright law).

Well I'll be darned. Now I have to run down to the courthouse and pull my lawsuit over the Death by Chocolate Fudge infringement.

What if someone sneaked into a 5 star restaurant that was attached to the resort he was working at and used a digital camera (in a very James Bond kind of way.) to photograph a bunch of recipes from the head chefs recipe book? :147:

This is of course a completely hypothetical situation...

It all depends on whether or not the resort has a bidet in every washroom.

Yes, ideal for radishes. The same can be done for those resorts equipped with water meters installed backwards. Unexpectedly refreshing I hear.

Yeah, well, that got derailed nicely ...

I don't see it as being illegal, however, the book was copyrighted ... and that should make it illegal, yes?

Words and music are copyright protected ... why are recipes any different?

My photographs are copyrighted ... they are my personal art. If a recipe is construed as a chef's "art", why would that be any different?

Just asking ....... :D

It is illegal unless you forward the royalty for making the copy to the appropriate copyright group responsible for collecting and distributing the royalties to the author/publisher.

As writerdave said, it's not like you will get caught writing it out for a friend. Only the 2 of you know. But if you take it in to any copy center, they are supposed to charge you the extra nickle (used to be a nickle) for each copy you make out of a copyright book. They are also supposed to make a copy of the page in the front showing the copyright so the royalty gets sent to the correct place.

I've always been curious why these copyright agencies have not made a case against self serve copy places. Or maybe they have and it wasn't a big news story.
