ICBC claim question
I am looking for some feedback on what is a fair settlement for level 2 whiplash injuries, including constant headaches more than half a year after being rear-ended. I'd appreciate feedback from anyone who has had a similar experience or has some idea of what $ range would be reasonable. Thanks!

I heard that ICBC has a $5000 limit on soft tissue injuries. Whiplash would be considered that I believe.
I've been rear ended several times in the past 20 years with two of those causing whiplash(the others were light impact,although my car didn't fare too well!) After one of them,I took physiotherapy and massage for a couple of years to deal with the headaches but the thing that helped my the most was faithfully doing yoga and stretching.
$5000 doesn't seem like much if you are unable to perform daily living tasks pain free. Unfortunately,ICBC doesn't offer individualized claim service. good luck

I still have a constant headache. It has improved but is still always there and nothing relieves it. My back is generally fine except for when I do a lot of repetitive bending, as in certain tasks at work.
$5000 is only slightly more than I was offered to settle less than 2 months after the accident and it has been nearly 8 months now. I've never had to deal with ICBC before, so I really don't know what to expect or hope for.
In my opinion, the impact was significant. I was hit by a pick-up pulling a large trailer, and I'm not sure that he ever hit the brakes. My van was written off.

See a lawyer. I did for both of my accidents, I did not have much in the way of injuries but ICBC was giving me the full run around, and quite honestly I didn't have it in me to fight em.
It wasn't about the money, (I didn't get much) it was the principal. And I refused to be walked all over, and have some small minded adjuster tell me that broken ribs generally pay out at 600? Huh?

I wasn't going to get a Lawyer, but after ICBC started to get shirty I did - I prolly received less but at least I felt I was somewhat protected. I think usually the rate is 30% of your settlement. I was told $3000.00 was what ICBC used as a standard for soft tissue injury/whiplash.

My brother-in-law had two back to back rear enders, and he received 14,000.00 for the two accidents combined. That was around Dec./Jan./08.

Get a lawyer. Mine laughed when he saw the first offer they made me - the one that made me seek him out.
People seem not to see that their opinion of the world is also a confession of their character.

You don't need to get a lawyer. That does not mean that you shouldn't get some legal advice.
A lawyer will possibly get you more, but after they take their fees, you may end up with less than if you were to deal with it on your own.
The most important thing to do, or not do, is to settle because you feel pressured or you want to have it over with because of the mental grief that ICBC will hurl at you. Remember that they are only doing that in hopes that you will cave and ultimately settle for less than you should.
Refuse to accept their offers until the offer is reasonable and comparable to other settlements for the same type of injuries.

They will negotiate, my brother-in-law was offered 6000.00 per accident he said he was looking for more like 7000.00 and they cut him a cheque very soon after for the amount he asked for.
It really wasn't a hassle. They obviously wanted proof of his injuries ie: Dr's letter, physio letter etc. once he provided all his paperwork it was very quick.
