Who does Colin Basran think he is telling me where my charity may or may not go? How bout go screw yourself and your food bank, *bleep*? Don't you dare tell me what I should or shouldn't do with my spare change!

Oh, then they should come after all of the castanet forum community. If a can is worth a nickle to a can collector, then our collective posts must be invaluable to humanity.

On the bright side - several civic politicians are making it a slam dunk to being out of a job come this fall - and it can't happen soon enough.

In one thread a majority of people are upset about the panhandling that goes on and junkies begging for money. This thread is about possible solutions to the previous problem and a majority of people are upset.

So which is it? :135:

I beg to differ on the simple fact that this is about people that are not happy with a city council telling them what or who they can - and can't give their own money to.

The City can give away my tax dollars but fine me for donating some effing cans?
I am going to make it a point to donate my cans.

Almost all of the components in the Population Control Good Neighbour Bylaw are contrary to the Constitution of Canada (read Charter of Rights and Freedoms) and on challenge the bylaw will be declared invalid. I suspect that Mattiussi / Basran know this.

There is a specific reason that all the fines top out at $500 and one of the amendments was to bring a $2,000 fane and 90 days in jail to the $500 amount. The reason is that it enables any violations can bypass the courts instead by put into the Bylaw Adjudication process where an Adjudicator is strictly limited to determining, on a balance of probabilities, if a bylaw as written was violated and if so the specified fine sticks like glue, payable immediately - plus $25 more to compensate the City for its troubles. An adjudicator is not permitted under legislation to give any consideration to contributing factors or adjust the specified fine in any way. There is no appeal available from an Adjudicators decision. Oh, one last thing. The City pays the adjudicating organization directly!

Fortunately there is a way out of this. An Adjudicator is unable to to hear bylaw violations if there is a claim that involves a claim that Charter of Rights violation, so all one needs to do is claim the Charter has been violated. Once this claim happens the City's only recourse if they want to pursue it, is to bring the violation to the Provincial Court where everything is on the table ..... including a determination of whether or not the bylaw is valid in the first place.

Easy-peasy Mattiussi/Basran! See you in court - I'll be calling as a witness and you can describe to the Court the considerations you gave to the bylaw in regards to validity under the Constitution. Good luck with that.

My daughter works on Kirchner Road and is intimidated when she arrives at her car to find someone lounging on it or that someone has relieved themselves on one of her tires. People think they are doing the right thing by donating their bottles to these people but all it does is to attract more of the same exacerbating an unsafe situation.
So you think that your need to hand out spare change trumps the rights of motorists to not be harrassed at intersections and distracting drivers. Tell that to the judge.
You are not giving money for food or other necessities you are handing out money for booze and drugs and encouraging lawlessness.
You are attracting petty thieves to discourage law abiding citizens from using Kirschner Road businesses who pay taxes and employ residents.
I don't see the mayor as the imbecile here.

The bottle pickers would be hanging around the bottle depot there even if no one gave them a can. Last Summer they had quite a lil camp set up.
I have never seen anyone give to the people panhandling on the intersections. Beats the guys leaping out to wipe your windows.

I've never once been harassed by a street person. Maybe it is because I say hello and smile when I walk by them. Try that, it might go a long way!

Last I checked, booze is not illegal and pretty soon drugs won't be either. Why do you think only one sector of the population should not be permitted to have a beer or six.

If there is an issue with people relieving them self on a parked car tire perhaps the quick and easy solution would be for the City to position a couple of porta potties in the location. Same goes for giving people a place to sit down and rest - a bench or two would do wonders.

BTW, the mayor is a imbecile.
