Mandatory release? People doing federal time can apply for parole after serving a third of their sentence. That would require they have a release plan and report regularly to a parole officer until their warrant expiry date. Offenders not wanting to deal with parole can be released after serving two thirds of their sentence (early release) if they have performed well while incarcerated. Offenders who are uncooperative while incarcerated can be held until their warrant expiry (original sentence). That is the only situation where release is mandatory, and it requires the sentence be completed in its entirety.

I guess you could go try and see for yourself. I don't know what's so hard about it. You're told when to sleep, when to get up, when to eat and when to go to the bathroom. I'm sure you could handle that. Maybe you would even be happy not to have to make any of those hard decisions for yourself anymore. Hey, you're right - it sounds like a freaking vacation.

And, of course, I believe that the lash should be used on multiple repeat offenders of crimes less than murder.

Whatever he got it wasn't "life" there is no mandatory release for life.

All other terms, once 2/3'd of the sentence is served the prisoner is subject to mandatory release.

I love reading in the media..... "Joe Blow was sentence to 10 years for....." and people are outrage he only got 10, well after they subtract his pre trial custody time and then apply the mandatory release, Joe won't serve anywhere near even the 10 they are angered about.

Hey there are rights in Canada ! Too bad those rights apply to criminals and not the honest hard working tax paying citizens.

Statutory release

Statutory release is a mandatory release by law. It is not parole and is not a decision of the Parole Board of Canada. By law, most offenders (except those serving a life or indeterminate sentence) must be released by the Correctional Service of Canada (CSC) with supervision after serving 2/3's of their sentence, if parole has not already been granted.

Offenders on SR are required to follow standard conditions which include reporting to a parole officer, remaining within geographic boundaries, and obeying the law and keeping the peace. The Parole Board can also impose special conditions specific to the offender. In some instances offenders on SR are required to reside in a halfway house or community correctional centre operated by CSC.

Statutory release aims to provide offenders structure and support before their sentence expires to improve the chances of their successful reintegration into the community. Offenders can be returned to custody if they violate their conditions of release or are believed to present an undue risk to the public.

CSC can refer SR cases to the Parole Board for detention until the end of the sentence. The Board may, in specific cases where the legal criteria are met, order these offenders to be detained in prison until the end of their sentence.

So, although it is termed mandatory release and the processes are there to monitor and supervise, there are circumstances where an offender can be deemed as an undue risk to the public. I had understood that included being confined in prison, but have known of offenders who were released and placed on a section 810.2 Recognizance to remain under supervision even after their warrant expiry date. You are absolutely correct that a life sentence has no warrant expiry date; only the possibility of parole after a minimum amount of years as determined by a Judge at sentencing.

Three skeletons found in his planters? He's going to claim "criminal insanity" or "I had no idea they were there!"

Why are we so accomodating? Burden of proof can be difficult I am aware. Especially in this case. Maybe there really was a stranger coming on to his property and burying dead men in his planters and he knew nothing about it. That would get him off from being an accessory to covering a crime, right?

It wasn't his property. He did gardening and landscaping at a number of properties.

Investigators said they have seized more than 12 planters from properties where McArthur did landscaping and that they plan to excavate two areas, but did not say where.

Smith and Fraser were first introduced to McArthur, a landscaper, by his sister. He needed a space to store some equipment and they made an arrangement: he could use their garage if he’d mow their lawn when they were away. Over the years he did much more than cut the grass.

“He took this simple arrangement and did more and more and more for us,” Fraser told the Star earlier this month. “All of our pots around the house were suddenly filled with beautiful flowers.”

McArthur had brought three or four enormous planters, roughly a metre high and as wide as the inside of tractor tire, to the house two or three years ago, Fraser said.

Wow, shortly AFTER the trials, the cult leaders and those responsible for the 1996 deaths of 13, were hanged.

Japan doesn't pussyfoot around with endless appeals and 20 years on death row, I GUESS.

We have criminals lounging around who have killed almost 13 people, Bernardo comes to mind.
As WW3 develops, no one is going to be dissing the "preppers." What have you done?

Sounds like being in the armed forces, probably with a lot less discipline. Even sounds similar to the northern camps I worked in, some of which were totally isolated. The only difference is in the forces and the camps you work your butt off.

Makes me angry when ppl get off easy for their terrible crimes, or get perks when they are supposed to be in jail. Yesterday I read a woman who murdered her 12 year old daughter will now get escorted outings to attend church.
I agree with Ferri, bet the death sentence has stopped some murders.
Let the victims family decide the punishment. I wonder how many would choose the person be put to death?

I`d rather see people spend actual life in prison.
At any given time at least half the population can`t believe any system associated with the government can do anything right, what makes anyone think it`ll work for Capital Punishment?

I would sooner see them dead than back out in the public. It would be bad if someone was wrongly executed but in my mind it would be better than all the ones that are getting out and hurting so many innocent people again under the current system. Even killing innocents in many cases. There will never be a perfect system and I would sooner error on the side of the most innocent victims. If we are going to keep them in prison then there must be some way that they can look after themselves and get rid of as much of the costs as possible. Most of these people do not deserve the public paying for their care.
