You hit the nail on the head... looking at the team of cougars taking the case.... they will find out which one has had tough family upbringing... ,, advise him to take the charge and then plead for him... as he was a golden boy... with no intent... ho hum
Fuddle Duddle.. you pick your friends and know full well what is going on... time will tell and probably a media ban... as well...

im not talking about that , im taking about physical evidence . now we know they took off and both didnt stop to offer aid to the injured person and i have no doubts they are both guilty of what crimes that entails , but im having a hard time thinking they both can be charged with hitting the person with the car when only one was driving .

we have to be realistic in what this case is going to end up being .

Seems the eeny, meeny, miny, moe game some appear to be counting on will be answered when the footage from the body cam worn by Officer Harnett is presented in court.

its not a game , its the reality of the court case coming up . the calgary police have said publicly the older one was a passenger . so that would make the younger one the driver. Then will come intent , did the driver wake up that day and tell someone they ment to go run some over ? when they did get pulled over did any of them say or shout they were going to injure or kill the cop ?

Doesn't matter. Crimes against police officers get upgraded to first degree murder automatically, no need for intent.

I don't think you understand. They don't have to prove the intent or first-degree murder. They just have to prove that somebody caused the death of an officer, and they automatically get first-degree murder punishment.

Has nothing to do with what the cops "bring" - this is the law:
(4) Irrespective of whether a murder is planned and deliberate on the part of any person, murder is first degree murder when the victim is

(a) a police officer, police constable, constable, sheriff, deputy sheriff, sheriff’s officer or other person employed for the preservation and maintenance of the public peace, acting in the course of his duties;
You would have read it already.

where in the law does it say one person driving , the passengers are automaticly guilty ? the cops recommend charges and then the crown has to decide what they can prove .

A good example is all the calgary cops charged with crimes that we know were not all found automaticly guilty , so why should it be any different for the rest of us ?

Wasn't responding to who was driving etc. obviously just posting the law regarding the murder charge of police officer. The two turned themselves in so now it's up to the legal system. Serious questions should be posed to those that are in the field to answer them.

Not a good example at all. The passenger was wanted, the driver was driving a vehicle with plates that didn't match (I'm guessing it was stolen) and the Calgary officer died doing his job. If you want to know why the law is different write your MP.
