Yes, he should have ordered Paul Bernardo be sent back to maximum security. The Justice Minister should be able to send anybody to any level of confinement, overriding whatever judges and corrections leftists believe.

Mendicino could similarly issue an order-in-council to transfer Bernardo back to a maximum-security prison based on sections 96(d) and 96(z.6) of the Act.
In the past, the Minister of Public Safety can, and regularly has, issued directives dealing with larger classes of inmates, on issues ranging from the use of cells designed to prevent drug smuggling to banning offenders like child killer Terri-Lynne McClintic from serving their sentences in low-security healing lodges.
Absolutely nothing would prevent the minister from directing that all inmates like Bernardo, who are serving life sentences for multiple first-degree murders, be kept in maximum-security prisons.
Also, he is (was) the Minister of Public Safety, not Justice Minister.
