Facing eviction on WFN
Why people buy houses on rented land is beyond me.

I live across the street from them. It's horrible what is happening and it's even more disgusting that WFN would allow it. I never would imagine that this could happen when I moved here from Saskatchewan. If I would have known that WFN is like this, I would not have even thought about buying here!!!!!

Reading the story and flipping through the pictures it sure sounds like the Tomat family is just doing what they know they can. I'm not sure why they are doing so other than "because we can". The home is beautiful but that's a huge risk throwing that much money into a home that sits on rented land. I'm sure the family is not enjoying the rest of the holiday in Arizona.

Seems so short sighted...isnt the Tomat family worried about creating such a unfriendly reputation for having a lease agreement with them. Who would trust them in the future? Im surprised anyone would invest any money in something like that. Really sad for them.

they are home now, they could not go this year because of this. I live across the street :( I was stupid enough to buy my house too. I don't feel sorry for the couple at all. We all know that dealing with the natives is always unfair. They can make up their own laws as they feel suits them. Who else can have a road block with loaded guns???? Anyone who rents/buys on native land knows that there are always risks involved. There seems to be alot or "feel sorry for me" in this story but I am having a hard time feeling sorry some one who spends the winter in Arizona and then spends the summer on the lake here. Another question I have is that the story says that they were served an eviction notice in February of 2014.That is 11 months ago. Why have they decided the tell their story now???? The mobile home is worth nothing. We all know that.They are trying to sell a rented lot that someone else owns.i will repeat my self again but I do not feel sorry for this couple.

I will never do business with a First Nations band...
The Tsarlip band in Brentwood Bay ( Central Saanich) did the same thing to residents of an entire mobile home park back in 98..
After a colleague of mine had secured a mortgage on his home , the band kicked EVERYONE out...He was 1 year into it.

they did not tell the story till now because their lawyer said not to. they have been going to court this whole time. Yes they do spend time in Arizona, in a motorhome. I own the house across the street from them, yes, I am stupid for thinking this could not happen but if it does happen to me as well.........I don't have the kind of money to fight it and neither do they. My money, as well as theirs went into the home that they/I thought I would be able to retire in. I would have thought that when this couple bought the house, their lawyer would have alerted them to the pitfalls of buying on WFN land, especially with only a month-to-month lease.

The WFN actually has stricter and very well detailed bylaws regarding their tenancy act....and it's unfortunate that people who buy in these parks don't bother to get a copy and read them inside out.
I'm sure they waited 11 months because they must be given 12 months noticed to be evicted for the reason given...that the owner wants to use their land for another purpose. I'm sure they were hoping something could be sorted out in that time.
I do feel for them...but, I would certainly never pay $300,000 for a mobile home !
The problem is, they paid for the lake front lot and not for the actual value of the home on it.

I'm trying to figure how in fact they don't own the garage, yet it's been included in the chattels of the two previous sales.

One more lesson in getting involved with WFN. Or any band really. If you rent from them, you live by their rules. And the rules can change. Documents don't mean a lot, not much more than a verbal agreement. Rents can go up. By a lot. Eviction notices can come anytime. If you sink your life savings into a home on their land you could lose a big chunk of it. The laws that apply off-reserve don't necessarily apply on reserve land.
It has nothing to do with racism. The rules on that land are different, or absent, or made up on the fly.
